Have you ever try to check W3C validation for Google.. that also have few error and bugs...It matter for SERP but not necessary..

After google penguin update there are a lot of things need debate and explanation however we should not use flash in our website because it could be harmful to get good ranking position in SERP.

What do you wanted to say, We can not get rank for website which used Flash in websites??... there are many other examples are available for the same.. There are lots of website which have flash banner and that rank well on competitive keywords.....
